APPLICANT PRIVACY POLICY

1. Our Commitment to Applicant Privacy
Suffolk Mechanical, LLC, doing business as Shaw Boiler and Mechanical (“Shaw Boiler and Mechanical,” “SBM,” “we,” “us,” or “our”), respects the privacy of individuals who apply for employment or otherwise express interest in joining our company.
This Applicant Privacy Policy explains the types of information we may collect during our recruiting and hiring process, how that information may be used, and how we work to protect applicant information.
This policy applies to information submitted through our Careers Page, CareerPlug, job boards, recruiting services, email, text message, telephone, in-person applications, referrals, and other recruiting or hiring channels.
This policy applies to applicants and employment candidates only. It is not an employment contract, offer of employment, or guarantee of employment.
2. Information We May Collect
Depending upon the position and stage of the hiring process, we may collect information including:
- Name, address, telephone number, email address, and other contact information.
- Résumé, employment application, cover letter, and related application materials.
- Employment history, job titles, responsibilities, compensation history when voluntarily provided and lawfully considered, and reasons for leaving previous employment.
- Education, training, licenses, certifications, trade qualifications, technical skills, and professional experience.
- Information concerning experience with boilers, HVAC, welding, pipefitting, mechanical systems, construction, service work, management, sales, or other skills relevant to the position being considered.
- References and information provided by professional or employment references.
- Interview notes, evaluations, assessments, and other information generated during our hiring process.
- Driving qualifications and motor vehicle information when driving is an essential function of the position.
- Information necessary to verify employment eligibility and authorization to work in the United States.
- Information obtained through lawful background, driving-record, reference, or other pre-employment screening when applicable to the position.
- Information voluntarily provided by an applicant during the recruiting and interview process.
- Other information reasonably necessary to evaluate an applicant's qualifications and suitability for employment.
Applicants should not provide sensitive personal information that has not been requested, such as Social Security numbers, banking information, passwords, or other unnecessary confidential information through a résumé or initial application.
3. How We Use Applicant Information
Applicant information may be used to:
- Review and evaluate applications and qualifications.
- Determine whether an applicant meets the requirements of a position.
- Communicate with applicants regarding applications, interviews, assessments, job opportunities, and hiring decisions.
- Schedule and conduct interviews.
- Verify licenses, certifications, employment history, references, driving qualifications, or other job-related information.
- Conduct lawful pre-employment screening when appropriate.
- Compare an applicant's qualifications with current or future employment opportunities.
- Make recruiting, hiring, compensation, placement, and employment decisions.
- Maintain recruiting and hiring records.
- Protect the safety, property, systems, employees, customers, and legitimate business interests of Shaw Boiler and Mechanical.
- Comply with applicable federal, state, and local laws and legal obligations.
- Establish, exercise, or defend legal claims when necessary.
4. Sharing of Applicant Information
Applicant information is intended for legitimate recruiting and employment purposes.
We may share applicant information with individuals or organizations having a legitimate need for the information, including:
Authorized Shaw Boiler and Mechanical personnel, such as company ownership, management, hiring managers, Account Managers, supervisors, administrative personnel, and others involved in evaluating or onboarding candidates.
Service providers, including CareerPlug and other companies providing applicant tracking, recruiting, background screening, motor vehicle record checks, assessments, information technology, or other hiring-related services.
Governmental authorities or other parties when disclosure is required or permitted by applicable law, regulation, subpoena, court order, or other legal process.
We do not sell applicant personal information for advertising or marketing purposes.
5. References and Verification of Information
By providing references or other professional contacts during the application process, applicants understand that Shaw Boiler and Mechanical may contact those individuals when appropriate and permitted by law.
Applicants are expected to provide complete, accurate, and truthful information throughout the application and hiring process.
Material misrepresentation, falsification, or omission of information relevant to employment consideration may result in removal from consideration or, if discovered after hiring, may result in disciplinary action up to and including termination of employment, consistent with applicable law.
6. Background Checks and Driving Records
Certain positions at Shaw Boiler and Mechanical may involve access to customer facilities, company vehicles, tools, equipment, financial information, controlled work areas, industrial facilities, hospitals, or other sensitive environments.
Where appropriate and permitted by law, candidates may therefore be subject to job-related screening, which may include:
criminal background checks, motor vehicle record checks, employment verification, reference checks, license or certification verification, and other lawful screening appropriate to the position.
Any third-party consumer report or background investigation subject to the federal Fair Credit Reporting Act or similar applicable law will be handled in accordance with the notices, authorizations, and procedures required by law.
7. Communications
Applicants may be contacted by telephone, email, or, when properly authorized, text message regarding their application, interviews, employment opportunities, or the hiring process.

8. Data Security
We take reasonable administrative, technical, and organizational measures to protect applicant information from unauthorized access, use, alteration, disclosure, or loss.
Access to applicant information is limited to individuals and service providers who have a legitimate business need for the information.
However, no electronic system, transmission method, or data-storage system can be guaranteed to be completely secure.
9. Retention of Applicant Information
We may retain application and recruiting information for a reasonable period following completion of the hiring process for legitimate business purposes, including recordkeeping, consideration for future employment opportunities, compliance with applicable laws, and the establishment or defense of legal claims.
Information maintained through third-party recruiting platforms may also be subject to the platform provider's applicable retention and deletion procedures.

10. Future Employment Opportunities
Unless prohibited by law or otherwise requested, we may retain applicant information and consider qualified applicants for other current or future positions within Shaw Boiler and Mechanical.
Applying for one particular position does not prevent us from considering an applicant for another position for which we believe the applicant may be qualified.
